Terms of Use Agreement

This Terms of Use Agreement sets forth the standards of use of the website at www.florenceacademystore.com (the “Site”) operated by The Florence Academy of Art (the “FAA” or “we” or “us”). By using the Site, you (“you” or the “Buyer”) agree to these terms and conditions. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice.
Modifications shall become effective immediately upon being posted at the Site.
Your continued use of the Site after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications.
Except as provided in this paragraph, this Agreement may not be amended.


1. Description of Service.The FAA is providing the Buyer with access to buy artwork.

2. Disclaimer of Warranties.The Site is provided by the FAA on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, the FAA makes no representations or warranties of any kind, express or implied, regarding the use or the results of the Site in terms of its correctness, accuracy, reliability, or otherwise. The FAA shall have no liability for any interruptions in the use of the Site.
The FAA disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties; therefore, the above-referenced exclusion may be inapplicable.

3. The contract of sale between the FAA and the Buyer shall be considered completed when the FAA, as a result of a customer order or orders, has sent the Buyer confirmation of the order and consequently implemented the contractual relationship with the shipment of products, as defined below, under the conditions described below. Notwithstanding the foregoing FAA reserves the right to communicate to the customer within 1 business day following receipt of the order, any number of conditions, on the basis of which FAA is able to execute the order.

4. FAA reserves the right to evaluate each request for modification and/or deletions and/or additional products relating to orders placed by the Buyer provided that such request is received by FAA at a time before shipment of the products themselves. The acceptance by the FAA in such applications, involves the debit against the Buyer of any additional costs incurred if shipment of the products in question is already started.

5. Limitation of Liability. THE FAA SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR THE FAA SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THE SITE OR THE INFORMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNTER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF THE FAA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; THEREFORE SOME OF THE ABOVE LIMITATIONS MAY BE INAPPLICABLE.

6. Disclaimer Regarding Accuracy of Vendor Information. Specifications about and other information regarding artwork for sale on the Site have been provided by individual artists and is not verified by the FAA. The FAA does its utmost to ensure that the artwork descriptions and photographs on this website give an accurate representation of the artworks you wish to buy. However, it is impossible to fully represent an artwork with a photograph. The FAA can make no representations or warranties as to the accuracy or reliability of any information provided on the Site. The FAA makes no warranties or representations whatsoever with regard to any artwork provided or offered by any artist, and the Buyer acknowledges that any reliance on representations and warranties provided by the FAA shall be at the Buyer's own risk.

7. Information for Buyers. Purchases of items from the Site are governed by the terms set forth in the FAA Buyer FAQ below. All prices on the Site are in U.S. Dollars. Buyers are responsible for paying all fees and applicable taxes in a timely manner with a valid payment method. If a Buyer's payment method fails, the FAA may collect fees owed using other collection mechanisms.

The payment of the fee may be made by:

A) PAYPAL
B) BANK TRANSFER

Buyers are responsible for paying all charges related to packing and shipment of the artwork, including insurance and possible customs fees and/or taxes.

8. Governing Jurisdiction of the Courts of Connecticut. The site is operated and provided in the State of Connecticut. As such, we are subject to the laws of the State of Connecticut, and such laws will govern this Agreement, without giving effect to any choice of law rules. We make no representation that the Site or other services are appropriate, legal or available for use in other locations. Accordingly, if you choose to access the Site you agree to do so subject to the internal laws of the State of Connecticut.

9. Privacy Policy. Under Article 13 of Legislative Decree No 30 June 2003.196. Personal data concerning the Buyer will be treated (hereinafter referred to collectively as the" Data "), by the FAA according to Article 4 of the code to carry out the activities necessary for the completion, management and execution of contracts for the sale of artwork.
Personal data is collected with methods and procedures strictly necessary to provide the interested parties the information required, and can be obtained through the use of fax, phone, electronic mail or other means of distance communication.
Providing some data is optional. In any case it is understood that the Buyer's refusal to provide required data makes it impossible to conclude or perform the relevant contracts for the sale of artwork by the FAA. The data may also be disclosed to other parties responsible for carrying out the transportation of products. The data is not otherwise disclosed. The customer can avail of the specific rights conferred under the same Article 7 of the Code.
